Pensioners who want to increase their monthly accrued amount sometimes do not know where exactly to turn. In this text, we will consider the question of where to go to have your pension recalculated, as well as the help of a lawyer in Moscow on this issue.

Grounds for recalculation

To determine where you can recalculate your pension, you need to figure out which one is required. The fact is that a pension today consists of many payments and additional payments. For example, a social supplement up to the subsistence level, although paid by the pension fund, is set automatically and therefore does not require a citizen’s application. But the additional payment in Moscow up to the city social standard is established only upon an application submitted to the social security service at the place of residence. Therefore, it is necessary to understand what a citizen receiving a pension can claim.

Studying the legislation on your own, unfortunately, is unlikely to help here. You need to be able to read laws at any level. In addition, it is not always clear which legal acts apply to pensioners and which do not.

Contacting institutions will also not always be the best solution. It is not always possible to bring together scattered information, and even more so. It is unlikely that a PFR specialist or social security employee will be able to fully explain what a citizen can claim.

This means that a reasonable solution here would be to contact a lawyer who is well versed in the law. The specialist will analyze the situation and tell you exactly what grounds the pensioner has for recalculation. The lawyer will also tell you where to go and what documents to provide.

Anna Yu turned to a lawyer for help. The woman moved to Moscow from Norilsk and was poorly versed in local laws. The woman was interested in what payments she could qualify for.
The lawyer carefully studied the case and recommended contacting the social security department to establish veterans’ payments, as well as writing an application for recalculation of the pension based on “northern” service.

When to contact the Pension Fund

The Russian Pension Fund is the institution where it is easiest to recalculate your pension. It is enough to decide on the basis and send the appeal to the authority.

  • Confirmation of experience acquired before 2002. For example, if a certain period of work is missing from the work book, it is not taken into account when assigning a pension. If the pension is assigned without taking it into account, the citizen will be able to request a recalculation if he can find supporting documents.
  • Redistribution of insurance periods. For example, a woman gave birth and raised 2 children, but at the same time worked at a job with a low salary. Both periods are included in the length of service by default, but they can be excluded from it by replacing them with insurance periods for the birth of children.
  • The emergence or change of dependents. For example, a citizen lives with a spouse who receives a social pension. Since the woman is a dependent, because is not able to work, the pensioner will receive additional payment. If another dependent appears in his family, the pension will be recalculated again, taking into account 2 dependents.

Cases are always individual. However, if we are talking about changing the exact amount assigned by the Pension Fund, then you should contact it.

When to contact social security

Strictly speaking, social security payments do not relate to the recalculation of pensions. But for many pensioners, almost all concepts related to pensions are identical. Thus, many people confuse indexation with recalculation, as well as the assignment of a monthly cash payment. Be that as it may, the question remains open: where to apply for recalculation of pensions, which is related to social protection of the population. Such situations include, for example, obtaining the status of a labor veteran.

Moscow pensioner V. turned to a lawyer for assistance. The man received a certificate of veteran of labor and wanted to know how to recalculate his pension. The lawyer said that the amount of the accrued insurance pension does not depend on the presence or absence of crusts. However, a pensioner is entitled to social supplements and other benefits, which can be applied for at the social security department at the place of residence.

Which authority should I contact?

In Russia, there are often situations when a person registered at one address actually lives at a different address, or even completely changes his locality or region. And older people are confused – where to go?

It all depends on whether the social security authorities were notified about the move. If yes, then you can contact the authorities at the new address. If not, there may be legal consequences.

Of course, the legislation allows you to interact with municipal and government agencies in any way:

  • at the place of registration;
  • at the place of residence;
  • at the place of stay;
  • according to your actual place of residence.

If the move was within the same city, no special problems will arise. But if a pensioner moves from Moscow to Vologda or any other city, then he may be required to make some additional payments (for example, up to the social standard of a Muscovite or the living wage of a pensioner in Moscow).

In general, you should contact exactly the authority where the pension (payment) file is kept in the case of the Pension Fund. As a rule, this is the Customer Service that the pensioner last contacted.

Every year, an increase for working pensioners in August is carried out by the Pension Fund according to the new Law No. 400-FZ. Not only the name of the allowance has changed, but also the basic calculation rules.

Currently, the increase in pension amounts in August for working pensioners is called recalculation. It is carried out without submitting an application. As a result, the number of points accumulated at the end of the year and the amount of monthly payments themselves increases.

Therefore, it would be incorrect to call such an increase indexation. is not carried out, but recalculation is carried out for work in August. You can find out what the increase will be in August and whether you are entitled to it from this article.

What pensions will increase from August 1

Calculation of additional payments is carried out only for insurance pensions. This is due to the fact that the increase occurs only due to insurance premiums. All other payments remain the same. It must also be emphasized that there will be no increase in the fixed payment from August. will also remain the same.

Working pensioners who receive old-age and disability insurance pensions have the right to an increase if they received a “white” salary. Recipients of payments in the event of the loss of a breadwinner also have the right to recalculation, but only once - from August 1 of the year following the year the payments were assigned.

What is pension recalculation in August for working pensioners?

First, you need to remember that the amount of any insurance pension is calculated based on (individual coefficient). And even after her appointment, their number is not final. For a working pensioner, their number may be increased.

Since 2015, all insurance contributions from our salaries are transferred into points and taken into account on an individual basis.

Many continue to work after retirement. In this case, insurance premiums from their wages continue to go to the Pension Fund. They are converted into so-called points. To receive them back as part of your paid pension, you do not need to write any applications. For this purpose, the Pension Fund of the Russian Federation will carry out an undeclared return of accumulated points annually in August for pensioners who continue to work.

Recalculation for pensioners in August (Clause 3, Part 1, Article 18 of the Law “”) is calculated based on unaccounted coefficients after the pension was assigned.

  • For example, recalculation in August 2019 for working pensioners will be calculated from unaccounted points for the period of work from January 1, 2018 to December 31, 2018. If he officially worked during the specified period, then an increase will be established for him from August 1.

Recalculation restrictions in August

Salaries, and therefore insurance premiums not taken into account after appointment, are different for all working pensioners. Therefore, the bonus in August will be individual.

But there are important restrictions introduced by part four of Article 18 of Law No. 400-FZ:

1. For “silent” pensioners who do not have a funded payment, the maximum such increase in August is limited to 3 points.

2. For those who create savings in non-state pension funds (NPFs) and management companies, the maximum increase in the month of August is limited to 1.875 points.

Due to the fact that since 2014 all our insurance premiums are transferred to the formation of insurance payments, regardless of the choice of NPF or Management Company, then for recalculation in August 2019 the maximum limit will be three points for everyone.

How is the increase calculated for working pensioners in August?

Let's look at the recalculation in August using examples. To calculate the increase from August 1, 2019, we need to know the following data:

1. The amount of unaccounted insurance premiums for the period of work from 01/01/2018-12/31/2018;

2. The standard amount of insurance premiums in 2018 (approved by the Decree of the Government of the Russian Federation is equal to 163,360.00 rubles).

Example 1. Recalculation for a working pensioner in August 2019 with a small salary:

  • Olga Sergeevna was granted an old-age insurance pension in 2012, but she worked as a pastry chef in 2018. Her salary was 16,000 rubles per month.
    Step 1. Let's calculate the annual amount of insurance premiums for 2018;
    A) The total annual salary is 192,000 rubles (6,000 rubles * 12 months)
    B) The amount of insurance premiums for the year is 30,720 rubles (192,000 rubles * 16%)
    Step 2. Let's convert the annual amount of insurance premiums into points; Let’s use the approved formula and the number of accumulated coefficients for Olga Sergeevna in 2017 will be equal to 1.88 (30720/163360*10)
    Step 3. Find out the increase in rubles;
    Due to the fact that Olga Sergeevna quit her job back in January 2019, the calculated coefficients must be multiplied by the current value of the pension point as for a non-working pensioner. As a result, we will receive an increase from August 1, 2019 in the amount of 164 rubles 01 kopecks (1.88 * 87 rubles 24 kopecks).

Example 2. Recalculation for a working pensioner in August 2019 with a large salary:

  • Anna Borisovna was granted an old-age insurance pension in 2014, but she continues to work to this day as a production manager. In 2018, her salary was 32,000 rubles per month.
    Step 1. We will calculate the annual amount of insurance premiums for the year;
    A) The total annual salary is 384,000 rubles (32,000 rubles * 12 months)
    B) The amount of insurance premiums for the year is 61,440 rubles (384,000 rubles * 16%)
    Step 2. Let's convert the annual amount of insurance contributions into pension coefficients;
    Let's use the approved formula and the number of accumulated points for Anna Borisovna will be equal to 3.761 (61440/163360*10)
    Step 3. Find out the increase in rubles;
    Due to the fact that the maximum increase is limited to 3 points, when recalculating Anna Borisovna from August 2019, only 3 coefficients will be taken into account instead of the calculated 3,761 points.
    And since it is continuously working to this day, the amount of increased payments will be 214 rubles 23 kopecks (3 * 71 rubles 41 kopecks).

From the examples given, you can see that the final amount of the increase as a result of the August recalculation for working pensioners depends not only on the points earned, but also on.

It is easy to calculate that in August 2019 the maximum increase in pension in August will be 261 rubles 72 kopecks (3 * 87.24 rubles) for non-working pensioners with an average salary of more than 22,000 rubles per month. It was this average monthly salary that constituted the maximum threshold of three points last year.

There can be quite a few circumstances for changing the pension amount. This includes the appearance of dependents, confirmation of length of service, and much more. But pensioners often do not know where and how to apply for recalculation. In this article, we will look at how to request a recalculation and what help from a lawyer in Moscow you may need.

Grounds for recalculation

Legislation is constantly changing, as are people's life circumstances. Therefore, there may be quite a lot of reasons for recalculation. For example, lawyers are often asked how to recalculate accrued pensions? And here the first advice always follows - to find a justification.

  • confirmation of insurance periods;
  • presence or change in the composition of dependents;
  • northern experience, including that acquired after retirement.

There are actually more circumstances. Each case requires individual consideration, since they do not always go “for the benefit” of the pensioner.

Moscow pensioner Evgenia P. turned to a lawyer for help in determining the possibility of changing the amount of her pension. The woman complained that she was given an old-age pension in the amount of 12,460 rubles. Since Evgenia could not qualify for Moscow social benefits due to living in the capital for 4 years, she wanted to receive more.
The lawyer undertook to help the woman and found out that one of the pensioner’s children was not included in her work experience, since before giving birth she had not worked for more than 3 years, and after giving birth she spent almost 8 years with the child. The lawyer recommended contacting the Pension Fund with a request for recalculation. The woman was charged an additional 2.7 IPC for the child, which in 2019 prices amounted to 235 rubles.

Where to contact

Before considering how to recalculate a pension, you should understand where exactly the citizen needs to apply. Since the Pension Fund deals with pensions in Russia, you should contact the Client Service at your place of residence, or where the payment (pension) file is located. You can submit documents to the Fund in any of 5 ways.

  1. Contact the Pension Fund Client Service in person.
  2. Send documents to the Foundation through the Multifunctional Center.
  3. Send the application and copies of documents by registered valuable mail (with an inventory) via Russian Post.
  4. Use the State Services portal or your personal account on the Pension Fund website.
  5. Send documents through a representative.

What documents are needed

To order a recalculation of pension benefits, you will need to at least write an application requesting to change the amount of your pension. Attached to the application:

  • identity card - civil passport or residence permit (for stateless persons and foreigners);
  • SNILS - a green card confirming registration in the Russian pension insurance system;
  • pension certificate - required in some situations;
  • documents confirming the circumstances for a legal change in the amount of the pension.

In the latter case, these are the papers that the Fund will accept and take into account when recalculating the amount of maintenance. For example, if an “additional payment for children” is required (accrual of the IPC for insurance periods for child care), then a birth certificate is used as confirmation. When confirming “northern experience” - a certificate from the employer, extracts from orders of employment, dismissal.

Appeal algorithm

A citizen who is counting on an increase in pension must follow simple steps. Either an employee of the Pension Fund Client Service or a lawyer will tell you how to apply for pension recalculation in a particular case. In general, the procedure looks like this:

  • identification of facts affecting the size of the pension;
  • collection of supporting documentation;
  • drawing up an application;
  • contacting the Fund's Client Service at the location of the payment (pension) case - as a rule, at the place of residence;
  • receiving a recalculated pension from the 1st day of the month following the month of application.

Something about timing

Unlike the assignment of a pension, in the event of its recalculation, no grace periods are provided. This means that if you receive a reasoned refusal due to a lack of or inconsistency of documents, you will have to go through the procedure all over again.

It is impossible to provide missing or correct existing papers. Consequently, if the pensioner does not meet the deadline before the end of the calendar month, he will be able to receive the increased pension a month later and only if the Pension Fund accepts the documents for recalculation later.

But things are somewhat different in controversial situations. Here, the appointment period is set from the 1st day of the month following the month of application, but provided that the pensioner prevails in the dispute.

Moscow pensioner R. applied to the Pension Fund for recalculation of his pension on the basis of inclusion in the special service according to List No. 1 of service in the Soviet Army in 78-80. However, the Fund refused, citing the refusal as not extending this period to the preferential period of service under List No. 1. The man turned to a lawyer for help. The lawyer filed a statement of claim in court on behalf of the client and won the case.

In 2020, due to the ongoing crisis situation in the country, the question of how to check the correctness of the old-age pension calculation worries almost every Russian. To receive a pension in a timely manner within 1 month, future pensioners must take care to prepare a package of documents and submit it with an application to the pension fund.

According to the new law on old-age insurance pensions, from January 1, 2015, new rules apply when calculating pension payments:

  • The need for a minimum insurance period. In 2015 - 6 years, in the future it is expected to grow, in 2016 - 9 years, in 2019 - 10 years. By 2024 and beyond, it should reach 15 years.
  • Availability of accumulated individual pension points. The minimum number is 6.6; a citizen who retired in 2015 must have had this number in order to have a minimum pension. In 2020 - 16.2, by 2025 the IPC should increase to 30.
  • Introduction of the pension coefficient– it is set by the government on the basis of economic calculations, and has different values every year depending on the level of inflation and the state of the economy. The cost of a PC in 2015 was 64.1, in 2016 – 71.41, in 2018 – 87.24 rubles.

This is a list of the main innovations used in calculating old-age pensions in a new way, when pension payments are assigned to a citizen upon reaching the age of 60/65 (women/men).

In the calculations, the main role is played by the number of contributions the employer made to the Pension Fund for the employee.

The pension is calculated and calculated by Pension Fund employees. The work book at the place of work is filled out by personnel department employees.

The human factor presupposes the presence of errors, they happen quite often, so a newly minted pensioner needs to check all the accruals.

If there are no errors in the applicant’s documents, then the error occurred due to the fault of the PF employee who was involved in the accrual. This is the simplest option, since the recalculation can be done again directly at the Pension Fund branch. The most important thing is to find these errors.

If it turns out that mistakes were made in the preparation of official documents during employment, then this complicates the situation.

To correct them, you must contact the personnel department of the institution where the citizen worked.

Difficulties will increase if errors in records were made at enterprises that no longer exist. In this case, you need to contact the archives.

In any case, sooner or later errors can be corrected, so it is very important to monitor the correct filling out of the work book during working life, and not during the assignment of an old-age pension.

If errors are discovered, you must contact the Pension Fund with a request to revise the calculations. Employees are required to accept the application, review documents, make changes and notify the applicant about what changes have been made and on what basis.

If the applicant is not satisfied with the results of the accruals, then he has the right to apply again for a recount to a higher branch of the Pension Fund.

Alternatively, you can recalculate your old-age pension yourself and verify or doubt the calculations made. To do this, the main thing that should be before your eyes is a certificate of income for any 5 years or for the period 2000-2001, a work book.

  1. Ask the Pension Fund for an extract from your personal account with the data that is necessary for the calculation.
  2. Use the formula for calculating the insurance part of the pension as of January 1, 2002 or.
  3. Calculation of the insurance part after 01/01/02. To do this, you will need the amount of insurance premiums paid by the employer, taking into account indexation. This information will be provided by the Pension Fund upon the citizen’s request. This is the pension capital that we need for the main calculation.
  4. Calculating the amount of valorization (what this term is) - increasing pension capital. The percentage of valorization is calculated for the years worked by the citizen before 1991. For the very fact of work, 10% is charged and for each additional year 1%, but not more than 75% in total. The calculation of the old-age labor pension for citizens who began working before 2001 is made by adding up all the data received: insurance parts before and after January 1, 2002, valorization and the basic fixed amount of the pension benefit, which is established by the government. 5334.19 rubles - this is its size in 2020, established on January 1.
  5. Calculation of the insurance part from 1.01.15. according to the new legislation, it is made by multiplying the IPC by the PC. The insurance part depends on the PC, which is set by the government. IPC is a collection of points, which is based on employer contributions and depends on the size of the salary. – 16.2. When calculating, points are converted into rubles by multiplying employer contributions by the cost of 1 point. You can see detailed calculations with examples.

Thus, calculations are not particularly difficult if you have all the information about your personal account before your eyes. In addition to the fact that it can be provided by the Pension Fund, you can see all the movement of funds in your account in your personal account on the government services website, after going through the registration procedure there.

Alternatively, you can use a virtual calculator to calculate the amount of your pension. The Internet is replete with similar offers, but it is better to use the calculator on the Pension Fund website - this is a more reliable option.

For those who are still far from retirement, it is also worth making calculations for the future in order to have an idea of what the size of the pension will be. If it seems insufficient, then it is appropriate to think about how to increase your official income today so as not to be upset about it tomorrow.

On April 1, 2019, President V. Putin signed an agreement providing for the indexation of pensions for non-working pensioners above the subsistence level(cm. ). Let us recall that on February 20, 2019, President V. Putin delivered a message to the Federal Assembly, during which he received payments not exceeding the subsistence level.

From January 1, 2019, insurance pensions were indexed by 7.05%, but pensioners receiving a minimum pension are subject to such indexation didn't feel it.

  • This happened due to the fact that the payments assigned to them are below the pensioner’s subsistence level (PMP). With the help of a social supplement, the amount of payment is brought up to the PMS, that is, they are actually paid.
  • The same situation has developed with social pensions, which were indexed.

Total in Russia about 6.5 million pensioners receiving a minimum pension. All of them, according to the President, “feel deceived,” because... For this reason, Vladimir Putin instructed:

Law on recalculation of pensions by decree of Putin

On March 4, 2019, the government introduced a bill to the State Duma, providing for recalculation of pensions, which includes a social supplement up to the pensioner’s subsistence level. The first reading of the draft took place on March 12, the second on March 19, and in the third reading it was adopted on March 21. The approval of the Federation Council was received on March 27, and on April 1, 2019, it was signed by the President.

As Rossiyskaya Gazeta reported, average increase as a result of recalculation amounted to:

  • 511 rub. - for recipients of federal social security. additional payments;
  • 876 rub. — for recipients of a regional supplement to primary care.

The head of the Pension Fund A. Drozdov noted that such re-indexation of minimum pensions in the next 6 years will additionally require about 150 billion rubles. The text of the law notes that already this year 18.8 billion rubles will be allocated for these purposes, and the indexed amounts will go to pensioners no later than July 1, 2019. Subsequent funding will amount to 20 billion in 2020 and 19.6 in 2021.

In addition, the new law stipulates that from January 1, 2020, the cost of living of a pensioner in the regions will be calculated using a unified methodology in order to avoid an “artificial” understatement of this value in the regions of the country.

How pensions will be recalculated in connection with the President’s message

According to the decision, pensions will be indexed starting from 2019 taking into account the cost of living of a pensioner. The increase from indexation will be set not to the assigned pension amount, but to the actual payment (already taking into account the EDV and social supplement to the PMP).

Let's look at the indexing order using a specific example:

  • Indexing according to the old rules. The pensioner was assigned a pension of 8,000 rubles. But in fact, in 2018 he received 8,500 rubles. - PHC in his region (8000 rubles + 500 rubles social supplement). As a result of indexation from January 1, 2019 by 7.05%, his pension increased by 564 rubles, that is, up to 8564 rubles. He began to receive exactly this amount (64 rubles more).
  • Indexation according to new rules (taking into account the cost of living). The same pensioner will have his pension recalculated. Now those same 500 rubles. social surcharges will be retained. Now he will receive 8564 + 500 = 9064 rubles, that is, 500 rubles more. more than he was credited with in January.

It is worth noting that such a recalculation will apply only to those pensioners who were assigned a pension below the PMP and were paid a social supplement up to the subsistence level or EDV. If the pension amount is greater than the PMP, then there will be no recalculation in connection with the President’s message. The recalculation will apply to both insurance and social pensions.

Putin about pensions in 2019 (latest news)

In his address on February 20, V. Putin noted that he did not affect citizens receiving social supplements up to the subsistence level. As a result of indexation, they simply stopped making such additional payments, but in fact the income of citizens did not change. The President ordered to eliminate the “injustice that has arisen.” The text of the President's address can be found below.

Social supplement for pensioners in 2019

Pension provision for Russian citizens cannot be less than the pensioner's subsistence level (PMP) installed in each specific region. If the Pension Fund has calculated the pension amount below this value, then the pensioner will be assigned social supplement(Article 12.1 of Law No. 178-FZ of July 17, 1999 “On state social assistance”).

Before the adoption of the changes announced by the President, as a result of annual indexations, the basic pension amount was increased, that is, the one that was assigned by the Pension Fund.

  • If the indexed payment amount was still below the PMP, then the social supplement continued to be paid, but already in a smaller size. Accordingly, a pensioner continued to receive a minimum pension, equal to the subsistence level in his region.
  • If the payment amount after indexation exceeds the PMP, then social supplement was canceled. In fact, the pensioner received an amount slightly more than the regional PMP. In fact, the citizen did not feel a significant increase in income from such indexation.

That is why President V. Putin ordered to immediately eliminate such injustice. He proposed to first bring the size of pension payments to the subsistence level, and then index it by 7.05%.
